As soon as an order is placed, regardless of the type of commission, or an adoptable of my creation is bought, the customer has agreed to the terms listed bellow.

If you want to be lazy and just skim through, the really important bits are BOLDED.

• You cannot decide that your own rules override those written here; by purchasing from me, you agree to these rules.

• If these rules and regulations are not followed, I reserve the right to ban you from adopting, bidding on or commissioning anything I create, and you shall be placed on a blacklist for however long I deem necessary. The rights to any and all art purchased from me are also revoked, and I may do what I see fit with it.

• These ToS are subject to change as I see fit.

1 | Basic Terms of Service

• Do not claim to have created any art of mine, or pretend that the characters illustrated are your own if you have not bought them. Nor shall you redistribute it or commercialize it.

• Transactions will be done with individuals only, not representatives of companies. No corporations please; I don't have a lawyer, you don't need one either.

• The specific rules listed in an adoptable, auction or your-character-here must be followed in addition to any guidelines here.

• I reserve the right to cancel a commission if I feel the need to do so, and will offer a full refund so long as the piece has not been finished.

• I will not refund payment if the customer is unsatisfied with the art/design; see bellow concerning minor changes, but once the art piece is completed, well. Tough luck.

• Failure to provide payment in a timely manner(one business week excluding holidays) after a sketch has been shown, an auction's end-date reached or a purchase has been approved will result in you revoking your right to the commission or adoptable. I may use whatever sketch I have for whatever I wish, with appropriate modifications, I may allow the runner up to win the auction and I may place the adoptable back up for sale in such a case.

• My currency equivalency goes as follows: 

    100 Points[DA] = 1 USD[Paypal] = 2 Gold Beatles[Lioden]

• As the creator of the art posted, any art purchased from me results in the buyer receiving partial ownership. I can still use this artwork to promote myself and repost anywhere I choose to; however, I will not make any further profit off it.

• The client has the right to use the artwork to depict their character[s] and repost wherever they see fit, so long as due credit is provided. Anyone else found doing so is an art thief and shall be treated as such.

• The client may also resell my artwork, or include it in the sale of a character, only so long as my guidelines concerning pricing are followed and these rules remain in place.

• No one has the right to modify my artwork in any way, period.

• Direct copying of artwork, be it via tracing, heavy referencing, colordropping or mimicking a design, is considered art theft by these ToS and will result in the user being blacklisted.

• I have certain pet obligations concerning the queen feline of the household and my baby wizurd lizurd. If they deem fit to fill my laptop with fur or poop on the keyboard in protest to something, I will automatically assume it is you who is at fault and obey their orders to destroy you. = ) *this is a joke*

• Though not a must, I do appreciate my work being acknowledged with at least a thank you; I may be reluctant to work for you in the future should these two words not be part of your vocabulary...

• I reserve the right to refuse any commission I feel is outside of my comfort zone; this usually concerns humans, anthros if naked, NSFW art and anything remotely discriminatory or that seems to have negative intentions behind it. I can also decline your commission if it's unclear, or if these rules have clearly not been read.

• Prices are subject to change at my discretion; however, these changes will not modify the cost of orders in place and will most often be warned of a week or two in advance.

• My life is a busy one; commissions of anything but a design on a base often take between two weeks and two months, depending on things such as muse, family life, school work and more.

• Progress on less time-consuming commissions, such as pixels and designs, will not be given unless specifically asked for by the customer.

• Generally speaking, work is executed in the order that the commissions are accepted and as the muse dictates once accepted. I can re-arrange my priorities to a point, but will not push your work in front of another's if that will break an agreed-upon delivery date. Please also allow for limited personal work, for I am not a machine and need to doodle things for myself to wind down between commissions. 

• I am willing to make commissions as a gift [user A orders a commission of user B's character as a gift for their birthday]; however, rest assured that in such cases I will check to make sure you are both indeed friends, or at least close. Commissioning art of a character you do not own is otherwise prohibited.

• You have the right to ask to keep the commission private and not have it posted to DeviantArt; in such cases, please be clear. No reasoning is required, just black-on-white that you wish for the art to only be in my stash and to not be shown to anyone else.

• Payment is preferably via Paypal, in which case it is in USD sent as Payment with your username and the commission form in the description. I also accept DA Points (), in which case they are to be sent via the Gift option unless total payment exceeds 1500 , where I will create a commission widget for payment. Lioden's GB currency is also accepted for certain types of commission. 

• I do not do payment plans.

• Discounts only apply to those listed in specific journals or with whom I have a prior agreement (namely ArcyAnderson). Do not attempt to haggle, because it will get you nowhere.

• As the commissioner, it is your responsibility to provide adequate reference for the character/design you want me to create; if you are unhappy with the end result I am willing to tweak small details (small markings, shift some colors, slight lineart edits) but otherwise will leave as-is. Additional payment may be discussed concerning more modifications.

• I will give versions of the piece without shading/background/textures if the customer asks, but will not, under any circumstance, remove my watermark nor provide .psd files.

• You do not have the right to redistribute the art, unless it comes included with a sold character and is thus no longer your property anymore.

• Placing the commissioned art on an application sheet for an RP group is perfectly acceptable, so long as credit is given in full.

• Should your commission be intended for use that shall earn you money (merchandise, t-shirts, advertisement, etc) we will need to discuss royalties.

3 |  Adoptables/Auctions/Designs

• I frankly do not care what you do with the design once you have it; tweak the design, change the species, modify colors, lop off a limb, bred it, turn it into an RP character, whatever. However, so long as in its distant past this design was created by me, you must still give credit where it is due.

• You only obtain ownership of the character once I receive payment; if it is never received, then the character is still mine until someone buys it.

• Payment is to be sent only when I reply with my approval of purchase; if Points or USD are sent prior to this, I will either return them or consider them a gift of goodwill, depending on my mood and the person's general attitude.

• In the event that you sell/trade/gift the design bought from me, please link any prospective buyers here and to the posted image of your design; if it was not posted, ask me for the stash link. Notify me once the switch in ownership is done, or be blacklisted.

• Adoptables, customs and auctioned designs can only be sold for the price the buyer payed for them or lower, plus the value of any art that would come with the character.

• Holds on adoptables will last indefinitely until another user has expressed interest in the design; then, depending on the price of the adopt or its popularity, I will ask for payment within 24 hours or a week. If payment has not been sent, then possible ownership is transferred to the next to have asked to buy the adopt.
